Live Auction Rules 1.You will receive a bid card when you sign-in/register for the event. To bid in the live auction, please hold your bid card up high with the number toward the auctioneer. 2.A bid acknowledged by the auctioneer is a legal contract to purchase the item and, if you win, you will be required to pay in accordance with these rules. Similarly, your written bid in the silent auction is a legal contract to purchase that item, should you be the highest bidder. 3.We encourage guests to use Express Pay upon registration to pay for purchases at the end of the live auction. Top bidders may pay for their items at the “bank”, which opens for regular service at the end of the live auction. You agree to pay for any item or items you win in full at the auction and prior to leaving the event. 4.Auction items will be awarded to one high bidder/purchaser only. You may not split the highest bid amount for an auction item among bidders who have agreed to pay for a portion of the top bid amount, i.e. no group bidding is allowed. In other words, if you bid on and win an item, you remain solely responsible for making payment in full for that item. 5.All purchases are final and there will be no exchanges or refunds. 6.We accept your payment by U.S. currency, personal check, VISA, MasterCard or American Express. Please make your check payable to “The Moyer Foundation”. As a 501 (c) 3, non-profit organization, your payments are tax deductible as a charitable contribution to the extent that they exceed fair market value of any benefits received by the donor. A tax receipt for all donations will be mailed following the event. 7.Unless otherwise noted in writing on a particular auction item, all auctions goods and services must be claimed and/or used within one year of the auction date. 8.The Moyer Foundation reserves the right to add or withdraw, without notice, items to or from the auction. 9.A winner of any given auction item assumes the responsibility to locate and remove the won item from the auction premises. Winners may claim gift certificates, tickets and passes at checkout. You may be asked to show your “paid” receipt and a photo ID for tangible items at the door when you depart. 10.All won items must be removed from the auction premises this evening. 11.The Moyer Foundation has attempted to describe and catalog all items correctly, but all items are offered “as is, where is”. The Moyer Foundation neither warrants nor represents, and in no event shall be responsible for the accuracy of any item descriptions, the genuineness or authenticity of any item, authorship, provenance or condition of items. No statements made in this catalog or made at the auction or elsewhere shall be deemed as covenant, agreement, warranty, representation or assumption of liability. 12.Each attendee who receives a bid number assumes all risks and hazards related to the auction and items obtained at the auction. Each bidder agrees to hold harmless for any liability arising therefrom The Moyer Foundation, its elected and appointed officials, members and employees, the auctioneer(s), the event organizers, sponsors, and/or volunteers connected with the auction.
